We have extensive well-rounded and multi-faceted Public Sector and Constitutional Law: Our Firm has regularly advised, from various perspectives, large SOEs on Public Sector Law, ranging from the Constitution, Public Finance Management Act and Related Regulations, such as Supply Chain Management Framework Regulations and related Directives and Circulars, Preferential Procurement Framework Act (“PFMA”), and Promotion of Administrative Justice Act. Our Firm is regularly advising Clients on compliance with these prescripts. In some instances, we conducted a PFMA Compliance Review which resulted in Clients effecting the necessary changes to the Supply Chain Management Processes and Procedures, to ensure compliance thereof.
We advise Clients on large scale and complex transactions with PFMA implications, particularly with respect to the procedures to be followed to execute these transactions and the necessary Treasury Approvals required. We have also been engaged to conduct a forensic investigation on a multi-billion project which also required compliance with the Constitution, PAJA, and PFMA and Client Internal Procedures. We also act in various High Court litigation matters relating to Supply Chain Management based on PFMA and Constitutional Requirements, including the Promotion of Administrative Justice Act.
We have extensive litigation and dispute resolution experience: We have been involved in various litigation and dispute resolution matters, some of which are based on multi-billion projects. The Lead Partner acted as a Judge in various Divisions of the High Court and also has over 15 post admission experience. Therefore, she provides the hindsight of Judge and an Attorney.
We have multi- faceted experience in Construction Law: in this case, we have advised on and drafted multi-billion contracts including both NEC Forms of Contracts and FIDICS Forms of Contracts. We are also acting in multi-billion construction disputes in the High Court and in the Disputes Adjudication Board. We have experience in drafting and negotiating contracts relating to the design, manufacturing, commissioning and testing of manufacturing plants and equipment.
Intellectual Property. Our Attorneys have studied Intellectual Property Law and have advised on a number of Intellectual Property. The experience includes litigation and disputes relating to trademarks infringements, negotiating and drafting licensing agreements. Recently our team is involved in a multi-billion infrastructure project which requires negotiating and drafting of Intellectual Property Licensing Agreements. We have drafted various Information Technology Contracts with comprehensive intellectual property provisions. We have also advised on TV Production Project and drafted the necessary contracts relating to Intellectual Property. We were also involved in the renewal of Intellectual Properties.
Commercial Law: We have provided legal opinions on various matters relating to breach and termination of contracts, matters relating the responsibilities of parties, force majeur, remedies of parties, and general commercial matters. We have drafted various contracts including large infrastructure contracts, mergers and acquisitions, sale of business, restructuring of State-Owned Entities, Conducting Due Diligence Exercises etc.
Legislative Drafting: Our Team members were involved in the legislative drafting process either in a lobbying capacity, by giving input and comments during legislation consultative process or through actual legislation drafting. Renqe also drafted a number of pieces of legislation during 2000 when she was employed as a Legal Advisor for the then Department of Environmental Affairs and Tourism.
- During 2009 Ms. Renqe was appointed by the Department of Health to draft the following Environmental Health Regulations, and she completed the project successfully:
- Environmental Health Inspection and investigations;
- Regulations dealing with mortal remains and funeral undertakers premises,
- Port Health regulations;
- Health Care Waste regulations;
- Public Health Nuisance Regulations.
Information Technology: Our Team provided legal opinions on various matters pertaining to Information Technology including interception and monitoring of electronic communications in terms of the Interception and Monitoring Prohibition Act and related Regulations, drafting Information Technology agreements, drafting and reviewing Information Technology Policies and Procedures, and implementation of Compliance Programs in terms of the Protection of Personal Information Act (POPI) and related General Data Protection Regulations due to the fact that Holding Companies were based within the European Union. Our team provided advise on the interpretation and implications of the Electronic Communications and Transaction Act, in relation to Commercial Transactions.
Labour Law: Our Team members were involved in various labour matters, including review of contracts for compliance with legislation, and interpretation in general, dismissals, section 189 procedures and chairing disciplinary inquiries. This relates to matters including Executives and Senior Management as well as employees in general. We have also reviewed bargaining agreements. We have also advised on labour relations implications resulting from sale and transfer of business.
Personal Injuries: Our team was involved in a number of various RAF matters, and personal injuries matters outside the RAF, for example, injuries sustained on site.
Conveyancing and Property Law: Renqe was admitted as a Notary Public during 2010. She has registered a number of servitudes for some of the State-Owned Entities.
